Terms and Conditions for ID Card Wallet

1. Acceptance of Terms

By downloading, installing, or using CardWallet (the "App"), you ("User" or "you") agree to be bound by these Terms of Use (the "Terms"). If you do not agree to these Terms, do not download or use the App.

These Terms constitute a legally binding agreement between you and Lazybyte Labs operated by Ikramul Hossain Mondal ("we," "us," or "our"), the developer and publisher of CardWallet. These Terms apply to all versions of the App on all supported platforms, including the Apple App Store and Google Play Store.

Apple Users: Please note that these Terms of Use are an end-user license agreement between you and Lazybyte Labs — not between you and Apple. Apple is not responsible for the App or its content.

2. License to Use the App

2.1 Grant of License

Subject to your compliance with these Terms, Lazybyte Labs grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use.

2.2 Restrictions

You may not:

Copy, modify, or distribute the App or any part of it.
Reverse engineer, decompile, or disassemble the App.
Rent, lease, lend, sell, or sublicense the App to any third party.
Remove, alter, or obscure any proprietary notices or labels on the App.
Use the App to develop a competing product or service.
Use the App for any unlawful purpose or in violation of any applicable law.
Attempt to gain unauthorized access to any systems or networks connected to the App.

2.3 Platform-Specific Terms

Apple App Store: This license is also subject to the Apple Media Services Terms and Conditions. In the event of a conflict between these Terms and Apple's terms, Apple's terms will govern with respect to platform-specific matters.
Google Play: This license is also subject to the Google Play Terms of Service.

3. User Responsibilities

3.1 Permitted Use

CardWallet is designed to help you organize and store your personal ID cards, documents, bank cards, and tickets for your own personal, lawful use only.

3.2 Your Responsibility for Stored Data

You are solely responsible for:

The accuracy and legality of any data you store in the App.
Maintaining the security and confidentiality of your device and App Lock credentials (PIN or biometrics).
Ensuring that your use of the App does not infringe upon the rights of any third party.

3.3 Prohibited Uses

You agree not to use the App to:

Store, reproduce, or distribute counterfeit, forged, or fraudulent identification documents.
Facilitate identity theft or any form of fraud.
Violate any applicable law or regulation in your jurisdiction.
Store documents to which you do not have a lawful right of access.

Lazybyte Labs reserves the right to terminate your license to use the App if you violate these restrictions.

4. In-App Purchases and Premium Features

4.1 Free and Premium Tiers

CardWallet is available as a free download and includes a limited set of features. Certain advanced features are available through a premium upgrade ("Premium"), which may be offered as a one-time purchase or as a subscription.

4.2 Payment Processing

All in-app purchases and payments are processed by:

Apple (via Apple In-App Purchase / StoreKit) on iOS devices.
Google (via Google Play In-App Billing) on Android devices.

Lazybyte Labs does not directly process, store, or have access to your payment information. All billing, refunds, and payment disputes must be handled through the respective platform (Apple or Google) in accordance with their terms.

4.3 Pricing

Prices for premium features are displayed in the App and are subject to change. All prices are shown in your local currency as determined by the App Store or Google Play at the time of purchase.

4.4 Subscriptions (if applicable)

If Premium is offered as a subscription:

Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before renewal.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
You may manage or cancel your subscription at any time through your Apple ID account settings (iOS) or Google Play account settings (Android).
Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a subscription period.

4.5 Refunds

All refund requests must be submitted to Apple (iOS) or Google (Android) in accordance with their respective refund policies. Lazybyte Labs does not directly issue refunds.

5. Intellectual Property

5.1 Ownership

The App, including all of its content, features, functionality, design, code, graphics, logos, and trademarks, is owned by Lazybyte Labs and is protected by applicable intellectual property laws, including copyright and trademark law.

5.2 User Content

All data you store within the App (your ID cards, documents, bank card details, etc.) is and remains your property. You retain full ownership of any content you create or store within the App. Lazybyte Labs does not claim any ownership rights over your data.

5.3 Feedback

If you submit feedback, suggestions, or ideas about the App to us, you grant Lazybyte Labs a non-exclusive, worldwide, royalty-free license to use such feedback for any purpose, including improving the App, without any obligation to you.

6. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you agree to the collection and use of information as described in the Privacy Policy.

7. Disclaimers and Limitation of Liability

7.1 "As Is" Disclaimer

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

LAZYBYTE LABS DOES NOT WARRANT THAT:

The App will meet your specific requirements.
The App will be uninterrupted, timely, secure, or error-free.
The results obtained from using the App will be accurate or reliable.
Any errors in the App will be corrected.

7.2 No Liability for Data Loss

BECAUSE ALL DATA IS STORED LOCALLY ON YOUR DEVICE, LAZYBYTE LABS IS NOT RESPONSIBLE FOR ANY DATA LOSS resulting from device damage, loss, theft, factory resets, operating system updates, App deletion, or any other cause. We strongly recommend maintaining your own backups of important documents.

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LAZYBYTE LABS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF LAZYBYTE LABS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT LAZYBYTE LABS'S LIABILITY CANNOT BE EXCLUDED, IT SHALL BE LIMITED TO THE AMOUNT YOU PAID FOR THE APP OR PREMIUM FEATURES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7.4 Apple's Limitation of Liability

Apple Users: Apple has no warranty obligation with respect to the App. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Lazybyte Labs's sole responsibility.

8. Indemnification

You agree to indemnify, defend, and hold harmless Lazybyte Labs and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to:

Your use of the App in violation of these Terms.
Your violation of any applicable law or regulation.
Your infringement of any third-party right, including intellectual property or privacy rights.

9. Third-Party Services

The App may integrate with or contain links to third-party services (such as Apple In-App Purchase, Google Play Billing, and Google ML Kit). These third-party services are governed by their own terms and privacy policies. Lazybyte Labs is not responsible for the content, practices, or terms of any third-party service.

10. Updates and Changes to the App

Lazybyte Labs reserves the right to:

Update, modify, or discontinue any feature of the App at any time, with or without notice.
Release new versions of the App that may change functionality or require you to update to continue using the App.
Withdraw the App from any app store at any time.

Your continued use of the App following any update constitutes your acceptance of any modified features or terms.

11. Termination

11.1 Termination by You

You may stop using the App at any time and uninstall it from your device. Uninstalling the App will permanently delete all locally stored data, as Lazybyte Labs holds no copies.

11.2 Termination by Lazybyte Labs

We reserve the right to terminate or suspend your access to the App immediately, without prior notice, if we determine that you have violated these Terms.

11.3 Effect of Termination

Upon termination, your license to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to binding arbitration or, where arbitration is not permitted, to the competent courts of India.

Apple Users: If you have a claim against Lazybyte Labs with respect to the App, Apple is not a party to any such dispute. Any dispute will be between you and Lazybyte Labs directly.

13. Apple-Specific Terms

As required by Apple for all apps distributed through the App Store, the following terms apply to iOS users:

13.1 Acknowledgement

You and Lazybyte Labs acknowledge that these Terms are between you and Lazybyte Labs only — not with Apple. Apple is not responsible for the App or its content.

13.2 Scope of License

The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded device that you own or control as permitted by the App Store Usage Rules.

13.3 Maintenance and Support

Lazybyte Labs, not Apple, is responsible for providing maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

13.4 Warranty

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App.

13.5 Product Claims

Lazybyte Labs, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

13.6 Intellectual Property Rights

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Lazybyte Labs, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

13.7 Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

13.8 Third Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

14. Changes to These Terms

Lazybyte Labs reserves the right to update or modify these Terms at any time. When we do, we will:

Update the "Last Updated" date at the top of this document.
Post the updated Terms at the link provided in the App Store and Google Play listings.

Your continued use of the App after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Lazybyte Labs with respect to the App and supersede all prior agreements, representations, and understandings.

These Terms of Use apply to CardWallet (ID Card Wallet), version 1.1.0 and above, developed by Lazybyte Labs. This document covers both the iOS (App Store) and Android (Google Play) releases of the App.
